USDA will finalize regulations governing the licensed production of commercial hemp.

As per the notice filed this week in the Federal Registrar office, there is a strong likelihood that by the end of this August, the United States Department of Agriculture (USDA) will finalize regulations governing the licensed production of commercial hemp.

Reports suggest that the US Department of Agriculture is going to take this step in order to ensure that commercial hemp cultivation is carried out in a manner that is in total compliance with the provisions of the 2018 Farm Act. As per this Act, all those US states that are interested in getting a license for commercial hemp cultivation may do so by submitting their plan to the US Department of Agriculture. However, this won't be possible until the Agency is able to finalize its own federal regulations. It should be kept in mind that the Agency had previously announced that it should be able to finalize such regulations and have them in place prior to 2020.

It is also worth noting that it was in the month of December that the Congress enacted legislation aimed at declassifying industrial hemp and products derived from hemp (that contain cannabinoids) from the federal Controlled Substances Act. Industrial hemp is defined as cannabis that has less than 0.3% THC content.
