Legislation Permitting Patients Home Cultivation Option in  New Hampshire Advances

An important piece of legislation (the House Bill 364) has been approved by the members of the Senate and House. The measure is aimed at permitting qualified patients to grow marijuana at home. Although, there are no public statements from the Governor on this bill, however in the past the Gov. has spoken out against broader legislation efforts.

As per the proposed measure, qualified patients (or their designated caregivers) who are enrolled in the state-authorized cannabis access program will now be allowed to cultivate a certain amount (up to 3 mature plants) in private location that is not subject to public view.

It is estimated that currently there are more than 6,500 qualified patients who are enrolled in the state-authorized medical cannabis program and are now authorized to have access to medicinal cannabis via any one of the four authorized dispensaries. It is also worthwhile to mention that lawmakers in 2018 passed an important piece of legislation that was aimed at raising the cap on the total number of dispensaries in the state.

Many of the national criminal and public policy reform groups working in the state have always opined that qualified patients should be legally allowed to exercise their option of growing their own cannabis instead of purchasing it from state-authorized commercial producers.
